The practical consequence: you can register Acme Plumbing at CIPC, discover the domain is gone, and find an unrelated Acme Plumbing already trading two provinces away with a trademark. All three of you are within your rights.
Check in this order
- Search the CIPC register for existing companies and close corporations.
- Search the trademarks database for the name in your class of business.
- Check the domain, both .co.za and .com.
- Search normally. If someone is trading under it and ranking, that is your future SEO problem regardless of who is legally right.
- Check social handles last. Nice to have, not decisive.
Do all four before you print anything. Rebranding at month three is expensive in a way that is hard to quantify and easy to avoid.
